Terms of Service

1. Acceptance of Terms

By accessing or using Toony Story (“the Service”), operated by Modlific LLC, a Utah limited liability company (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Toony Story is a web application that allows users to create personalized, AI-illustrated children’s storybooks. The Service uses artificial intelligence to generate story text and illustrations based on user-provided characters and preferences.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 13 years old, or have parental consent, to create an account.
• You are responsible for all activity that occurs under your account.

4. User Content

When you use Toony Story, you may upload photos and create content including characters, stories, and images. Regarding this content:

• Your content is yours. You retain ownership of the photos you upload and the creative choices you make.
• AI-generated content. Stories and illustrations are generated by AI based on your input. You may use the generated content for personal, non-commercial purposes.
• License to operate. By uploading content, you grant us a limited license to process, store, and display that content as needed to provide the Service. This license terminates when you delete the content or your account.
• No illegal content. You agree not to upload content that is illegal, harmful, or violates the rights of others.

5. Likeness, Photos & Consent

Toony Story allows you to upload reference photos of real people to create illustrated characters. By uploading a photo, you represent and warrant that:

• You have consent. You have obtained permission from the individual depicted (or their parent/legal guardian if the individual is a minor) to upload their photo and generate AI illustrations based on their likeness.
• Personal use only. AI-generated illustrations based on a person’s likeness are intended for personal, non-commercial use. You may not use generated likenesses for advertising, endorsements, or any purpose that implies the depicted individual’s sponsorship or approval without their explicit consent.
• No unauthorized likenesses. You agree not to upload photos of public figures, celebrities, or any individual without their consent for the purpose of generating content featuring their likeness.
• You assume responsibility. You are solely responsible for ensuring that your use of any person’s likeness complies with applicable laws, including right of publicity, privacy, and personality rights laws in your jurisdiction.

We reserve the right to remove content and suspend accounts that violate these requirements.

6. Intellectual Property & Trademarks

Toony Story is an independent service and is not affiliated with, endorsed by, or sponsored by any animation studio, film company, or entertainment brand. Any art style descriptions used within the Service (such as “3D animated” or “movie-style”) are used solely as descriptive references to guide the visual aesthetic and do not imply any association with or ownership of third-party trademarks.

• All trademarks, service marks, and brand names referenced in the Service belong to their respective owners.
• AI-generated content may unintentionally resemble copyrighted characters, styles, or properties. You agree not to use generated content in any way that infringes on third-party intellectual property rights.
• You are responsible for ensuring that your use of generated content complies with applicable copyright and trademark laws, particularly if used outside of personal, private contexts.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to circumvent security features or access other users’ accounts
• Use automated tools to scrape or overload the Service
• Generate content that is hateful, violent, or sexually explicit
• Resell or redistribute the Service without permission

8. AI-Generated Content Disclaimer

Stories and images are generated by artificial intelligence and may not always be accurate, appropriate, or consistent. We make reasonable efforts to ensure quality, but we do not guarantee that AI-generated content will be free of errors or meet specific expectations. We recommend reviewing all generated content before sharing with children.

9. Account Teams & Sharing

Toony Story allows you to create accounts and invite other members. Account owners are responsible for the activity of members they invite. Shared content within an account is visible to all account members.

10. Payments, Subscriptions & Refunds

Toony Story offers paid features through credit packs and subscription plans. All payments are processed securely by a third-party payment processor. We do not store your credit card number or payment details on our servers.

• Subscriptions. Subscription plans are billed on a recurring basis (monthly or annually) at the rate shown at the time of purchase. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.
• Cancellation. You may cancel your subscription at any time from the Account Settings page. Upon cancellation, your subscription remains active until the end of the current billing period. You will not be charged again after that period ends.
• Credit packs. Credit packs are one-time purchases. Credits do not expire and are non-transferable between accounts.
• Print orders. Physical book and merchandise orders are fulfilled by third-party print partners. Once a print order has been submitted to our fulfillment partner, it cannot be cancelled.
• Refund policy. Subscription payments are non-refundable except where required by law. If you experience a technical issue that prevents you from using the service, contact us at support@toonystory.com and we will work with you to resolve the issue or issue a refund at our discretion. For print orders, refunds or reprints are available if the product arrives damaged or materially defective.
• Price changes. We may change subscription prices with at least 30 days’ notice. Price changes will take effect at the start of your next billing period after the notice period.
• Free tier. Some features are available without payment. We reserve the right to change what is included in the free tier at any time.

California Auto-Renewal Disclosure: Your subscription will automatically renew at the then-current price for the same duration unless you cancel before the renewal date. You may cancel at any time from Account Settings. After cancellation, you will retain access until the end of your current billing period. A confirmation email will be sent when your subscription begins.

11. Your Data Rights

You may exercise the following rights at any time by contacting us at privacy@toonystory.com or through the Account Settings page:

• Delete your account — permanently remove your account and all associated data (characters, stories, images, uploaded photos).
• Request your data — receive a copy of all personal data we hold about you.
• Correct your data — update or correct inaccurate personal information.

12. Service Availability

We strive to keep Toony Story available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify or discontinue the Service at any time.

13. Indemnification

You agree to indemnify, defend, and hold harmless Modlific LLC, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property, likeness, privacy, or publicity rights; or (d) content you upload or generate through the Service.

14. Limitation of Liability

To the fullest extent permitted by law, Modlific LLC, its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or damages related to AI-generated content. The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied.

15. Dispute Resolution

Any dispute arising from these Terms or the Service will be resolved as follows:

• Informal resolution first. Before filing any formal proceeding, you agree to contact us at support@toonystory.com and attempt to resolve the dispute informally for at least 30 days.
• Binding arbitration. If informal resolution fails, disputes will be resolved through binding arbitration administered under the rules of the American Arbitration Association (AAA), conducted in Utah County, Utah. Each party will bear their own costs.
• Small claims exception. Either party may bring an individual action in small claims court in Utah if the claim qualifies.
• No class actions. You agree to resolve disputes only on an individual basis and waive the right to participate in a class action, class arbitration, or representative proceeding.

16. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through Account Settings or by contacting us. Upon termination, your data will be permanently deleted in accordance with our Privacy Policy.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Utah, United States, without regard to its conflict of law principles. Any legal proceedings not subject to arbitration shall be brought in the state or federal courts located in Utah County, Utah.

18. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

19. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page, updating the “Last updated” date, and sending an email notification for significant changes. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
